Should I accept rear-end blame or fight it after a St. George lane-shift crash?
The surprising part is that a rear-end collision in Utah is not automatically the rear driver's fault.
From the insurance company's perspective, this is the clean story they want: you hit the car ahead, so you pay. In a construction zone on roads like Bluff Street, Sunset Boulevard, or I-15 interchanges in St. George, they may ignore the details that matter most - sudden lane shifts, unclear cones, a flagger's signal, heavy equipment blocking sight lines, or the lead driver braking hard while turning left through a narrowed lane.
They also know a retired person with growing mobility problems may want the fastest check possible, especially if the injury now threatens independent living. So they push the simple version.
Reality is different. If the lead driver made an unsafe left turn, stopped unexpectedly in a shifted lane, or reacted late because of poor work-zone control, fault can be shared. Utah uses modified comparative fault. If you are found 50% or more at fault, you can be barred from recovering. If you are less than 50% at fault, your recovery is reduced by your share.
That means the smarter path is usually to fight the blame if the roadwork setup or the other driver's move contributed.
