"Were you working when you got hurt?" That is the adjuster question that can shrink or expand your case fast. No, filing workers' comp did not ruin a lawsuit in Utah. It only blocks a normal injury lawsuit against your employer in most cases because of Utah's exclusive remedy rule. But if someone other than your employer or co-worker caused the crash or made it worse - another driver, an armored truck company, a contractor, a property owner, a vehicle manufacturer - you may still have a third-party injury claim and a workers' comp claim at the same time.

Here's the part people get wrong: workers' comp and a lawsuit are not always either-or.

In Utah, workers' comp usually covers medical care and partial lost wages for job injuries, even if nobody was "at fault." That tradeoff is why Utah law usually bars you from suing your employer for the same injury. The employer's insurer will lean hard on that and act like every other claim is dead too. That is bad advice.

If the wreck involved a non-employer driver on I-15 in Ogden, a delivery contractor, or a dangerous road situation like a commercial crash coming off steep grades such as US-6 through Spanish Fork Canyon, the third-party side may still be alive. That claim can include damages workers' comp does not fully pay, like pain and suffering and fuller wage loss.

What matters now is timing and paperwork. In Utah, workers generally must report a job injury to the employer within 180 days. A workers' comp claim usually must be filed with the Utah Labor Commission within 1 year. A separate Utah personal injury lawsuit is often subject to a 4-year deadline.

One catch: if you recover money from a third party, the workers' comp carrier may claim reimbursement from that settlement. During tax season, that surprise lien can hurt if you were counting on every dollar.
